Welcome to eBooth, a service provided by Schweikhart Advisors LLC! These Terms of Service ("Terms") govern your access to and use of the eBooth website, mobile application, administrative interfaces, and generated interactive maps (collectively, the "Service").
Please read these Terms carefully before using the Service. By accessing or using any part of the Service, you agree to be bound by these Terms. If you do not agree to all of these Terms, you may not access or use our Service.
To use the administrative layout and mapping tools (the "Organizer Dashboard"), you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep this information updated.
You are solely responsible for safeguarding the credentials you use to access your account. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any unauthorized use of your account.
You agree not to use the Service to: * Upload, post, or transmit any map, vendor list, or content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable. * Infringe upon the intellectual property rights, privacy rights, or publicity rights of any third party. * Upload spreadsheets or files containing malicious code, viruses, malware, or any files designed to disrupt the operation of eBooth or another user's hardware. * Attempt to reverse-engineer, decompile, or extract the source code or underlying AI models of the eBooth processing engine. * Impersonate any person or entity, including event organizers, municipal representatives, or eBooth employees.
As an Event Organizer, you retain all ownership rights to the maps, layout documents, and vendor list spreadsheets you upload to the Service ("User Content").
By uploading User Content, you grant Schweikhart Advisors LLC a worldwide, non-exclusive, royalty-free, fully-paid license to use, reproduce, modify, adapt, publish, translate, and display such content solely for the purpose of providing, improving, calibrating, and promoting the Service (e.g., generating the interactive public map and training our layout extraction models).
By clicking "Publish" on any map draft, you explicitly authorize Schweikhart Advisors LLC to make the generated vendor map, vendor names, and associated categories publicly accessible via a web link or QR code to festival attendees.
The Service, including its design systems, frontend code, backend logic, databases, proprietary AI routing and matching algorithms, logo, and brand assets, is and remains the exclusive property of Schweikhart Advisors LLC and its licensors.
Certain features of the Service (such as publishing maps for commercial events or events over a certain size) require payment of fees. Current pricing tiers are detailed on our pricing page and are subject to change.
All payments are processed securely through our third-party billing partners. Except as otherwise provided by law, all payments for event licenses or subscriptions are non-refundable.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Schweikhart Advisors LLC makes no warranties, expressed or implied, regarding the accuracy, completeness, reliability, or availability of the generated interactive maps.
In compliance with the FTC Endorsement Guides, please be aware that the AI-generated map layouts and spatial extraction data do not constitute certified professional survey, architectural, or safety/compliance advice. The AI mapping tools are intended as a visual aid, and event organizers use them at their own risk. You are solely responsible for ensuring that physical event layouts comply with local fire codes and municipal safety regulations.
Schweikhart Advisors LLC is not responsible for event-site cellular network congestion, carrier outages, or offline access failures. We strongly recommend that organizers use eBooth alongside traditional signage, and pre-load mapping links on local device caches.
To the maximum extent permitted by law, Schweikhart Advisors LLC and its officers, directors, employees, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, resulting from: 1. Your access to or inability to access the Service. 2. Errors or inaccuracies in the AI-generated map layouts. 3. Any vendor disputes or operational issues occurring physically at the festival.
Schweikhart Advisors LLC complies with the Digital Millennium Copyright Act (DMCA). We respond to valid notices of alleged copyright infringement and will terminate, in appropriate circumstances, the accounts of users who are repeat infringers. If you believe your proprietary map, layout, or vendor data has been uploaded without authorization, please submit a written notification to our designated copyright agent at legal@ebooth.io.
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.
All provisions of the Terms which by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms shall be governed and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law provisions. Any dispute arising out of these Terms shall be resolved in the state or federal courts located in Warren County, Ohio.
